Family members have the right to work in the State. Non-EU citizen family members will be obliged to obtain a residence card in the State where they take up residence if they plan to remain there for longer than three months. This residence card should be issued within six months of submission of the application.

If the family member plans to travel to another Member State in the company of or to join the EU citizen, he or she should be able to do so simply on production of a valid residence card in lieu of a visa (ARticle 5). However, many Member States do not observe this provision and instead continue to insist on production of a valid visa. However, this visa should be granted without delay or charge or formality.
